GoldGremlin Terms and Conditions

Please read these Terms and Conditions carefully before registering, purchasing a license, downloading, or using the GoldGremlin Expert Advisor ("EA"). By using the software or the client portal, you agree to be bound by these terms.
1. About GoldGremlin
GoldGremlin provides automated trading software for the MetaTrader platform together with a licensing and client management portal available through GoldGremlin services.

2. Risk Disclosure
Trading foreign exchange, precious metals, commodities, cryptocurrencies, and other leveraged financial instruments involves significant risk and may not be suitable for all investors.
You may lose part or all of the funds in your trading account. Past performance does not guarantee future results.
You are solely responsible for evaluating the risks associated with using automated trading software and for determining whether such trading is suitable for your financial circumstances.

GoldGremlin and its representatives do not provide financial, investment, legal, tax, or accounting advice.
All information provided through the software, website, client portal, emails, social media, or support channels is for informational purposes only.
All trading decisions remain entirely your responsibility.
4. Eligibility
To register an account or purchase a license, you must:
- Be at least 18 years old.
- Have the legal capacity to enter into binding agreements.
- Provide accurate and truthful registration information.
You may not register or use GoldGremlin on behalf of another person without authorization.
5. License Terms
GoldGremlin is licensed, not sold.
Purchasing or obtaining a license grants you a limited, non-exclusive, non-transferable right to use the EA on the MetaTrader account associated with that license.
Licenses are tied to a specific trading account number unless otherwise agreed in writing.
You may not:
- Copy, modify, distribute, or resell the software.
- Share your EA files with third parties.
- Reverse engineer, decompile, or attempt to extract source code.
- Circumvent or interfere with licensing systems or security features.
- Use the software on an account that is not licensed.
6. License Verification
The EA periodically communicates with GoldGremlin licensing servers to verify license status.
If a license cannot be validated due to expiration, suspension, cancellation, misuse, or other licensing violations, the EA may be restricted from placing new trades.
GoldGremlin is not responsible for losses arising from internet outages, hosting issues, broker connectivity problems, or failed license verification caused by circumstances outside our control.
7. Paid Licenses
The current commercial product is GoldGremlin V1.X. That license covers the V1 line, including later V1 updates. A new product name, such as V2, is a separate license.
Pricing is displayed before purchase and may change for future purchases.
Payments are processed through approved third-party payment providers. GoldGremlin does not store your payment card details.
Upon successful payment and activation, the licensed EA becomes available through your client portal.
Because the software is delivered digitally and activated within 48 hours, purchases are generally considered complete once activation has occurred.
8. IB and Promotional Licenses
GoldGremlin may offer complimentary, promotional, trial, or introducing-broker (IB) licenses.
Such licenses remain valid only while the qualifying conditions are met.
GoldGremlin reserves the right to suspend or withdraw promotional or IB licenses if eligibility requirements are no longer satisfied.
9. Trial Licenses
Trial licenses are provided solely for evaluation purposes.
Trials may include feature limitations, expiry dates, usage restrictions, or other conditions determined by GoldGremlin.
A trial license does not constitute ownership or entitlement to a paid license.
10. Client Portal Access
You are responsible for maintaining the confidentiality of your login credentials.
All activity occurring under your account is your responsibility.
GoldGremlin reserves the right to suspend access to portal accounts that are involved in abuse, unauthorized sharing, fraud, or violations of these Terms.
11. Software Availability
GoldGremlin aims to maintain reliable availability of licensing services, downloads, and software updates. However, uninterrupted availability cannot be guaranteed.
Software functionality may be affected by:
- Broker settings and restrictions
- MetaTrader platform updates
- Network interruptions
- VPS or hosting issues
- Market closures
- Third-party service outages
Users are encouraged to test all settings on a demo account before trading on a live account.
12. Limitation of Liability
To the maximum extent permitted by law, GoldGremlin shall not be liable for:
- Trading losses
- Lost profits
- Missed trading opportunities
- Broker disputes
- VPS failures
- Data loss
- Service interruptions
- Indirect, incidental, or consequential damages
In any event, GoldGremlin's total liability shall not exceed the amount paid by the customer for the specific license giving rise to the claim.
Nothing in these Terms limits any rights that cannot legally be excluded under applicable law.
13. Intellectual Property
All software, content, trademarks, branding, source code, licensing systems, graphics, and documentation associated with GoldGremlin remain the exclusive property of GoldGremlin.
No ownership rights are transferred to users.
14. Changes to These Terms
GoldGremlin may update these Terms from time to time.
Updated Terms become effective when published. Continued use of the client portal, licensing services, or software after publication constitutes acceptance of the updated Terms.
15. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any disputes arising from the use of GoldGremlin products or services shall be subject to the jurisdiction of South African courts.
